These terms govern the use of the Pairs application (the “App”) and the associated service, offered by Arkode (“we”). By creating an account or using the App you accept these terms. If you do not agree, do not use the App.
1. The service
Pairs is a private application for exactly two people to exchange end-to-end encrypted text notes, images and voice notes. Our server acts only as a temporary relay for encrypted messages; history is stored on your devices and, optionally, in a backup in your own cloud.
2. Eligibility and account
- You must be at least 18 years old.
- You are responsible for keeping access to your account and devices secure, and for your recovery phrase.
- Each account can be linked to one couple at a time. You can unlink at any time.
- You must provide truthful information and not impersonate others.
3. One-time purchase
Some features (such as inviting your partner) require a one-time purchase per couple, made through the App Store or Google Play. The purchase is tied to the couple: once the person who paid is linked, the other gets access without paying again.
- Prices, taxes and billing are handled by the respective store under its own terms.
- Refunds are governed by Apple's or Google's policies; we cannot issue them directly.
- The purchase can be restored from the App on a new device using the same store account.
- We will never delete your data for billing reasons. Exporting your history is always available.
4. Your content
You keep all rights to the content you share. You grant us only the technical licence needed to transmit and temporarily store that encrypted content in order to deliver it to your partner.
Because content is end-to-end encrypted, we cannot view, moderate or recover it. You are responsible for keeping your recovery phrase and making backups; losing both means irreversibly losing any content that is not on your devices.
5. Acceptable use
You agree not to use the App to:
- Engage in illegal activity or infringe third-party rights.
- Harass, threaten or harm another person, including your partner.
- Attempt to access other people's accounts, interfere with the service or bypass its security measures.
- Reverse-engineer the App except where the law expressly allows it.
We may suspend or terminate accounts that breach these terms or pose a risk to the service or to others.
6. Pairing, safety and recovery
- When pairing you must compare the safety code in person with your partner. Do not approve recovery requests whose code you have not verified.
- Partner-assisted recovery requires your partner's explicit approval and changes your safety code; your partner will see a notice.
- If your partner unlinks, the couple's remote data is deleted and your local history remains.
7. Intellectual property
The App, its design, trademarks and code belong to Arkode or its licensors. We grant you a personal, limited, non-exclusive, non-transferable licence to use the App on your devices in accordance with these terms and the app store's conditions.
8. Availability and changes
We aim to keep the service continuously available, but interruptions may occur due to maintenance, provider failures or causes beyond our control. We may modify or withdraw features. If we were to discontinue the service, we would announce it with reasonable notice so you can export your history.
9. Disclaimer of warranties
The App is provided “as is” and “as available”. To the extent permitted by law, we make no warranty that the service will be uninterrupted, error-free or fit for a particular purpose.
10. Limitation of liability
To the extent permitted by law, Arkode shall not be liable for indirect, incidental or consequential damages, nor for data loss arising from the loss of devices, the recovery phrase or the user's backup. Our total liability to you is limited to the amount paid for the one-time purchase.
11. Termination
You may stop using the App and delete your account at any time from Settings. See how to delete your account. We may terminate your account if you breach these terms. Clauses that by their nature should survive (intellectual property, limitation of liability, governing law) remain in force.
12. Governing law and jurisdiction
These terms are governed by the laws of the United Mexican States. Any dispute shall be submitted to the competent courts in Mexico, without prejudice to any consumer rights you may have in your place of residence.
13. Changes to the terms
We may update these terms. We will publish the current version on this page with its update date and, if the change is material, notify you in the App. Continuing to use the App after a change means you accept it.
